Lowell/Overdale Court Claim - can I negotiate a settlement at this stage?

      Can you check the Claim form, does it say Defendant, or is it an error on your part?

      7. The Claimants statement of case states that the account was assigned from PayPal to the DEFENDANT on 15-09-21. The Defendant does not recall receiving notice of this assignment.

      Other then that it's good.

      You can lodge it with the Court via MCOL, you can send Overdales a copy, just get Proof of Postage.

              You are correct. It says "The debt was legally assigned to the claimant on 15-09-2021, notice of which has been given to the defendant."

              This is what I have put in my defence:

              "7. The Claimants statement of case states that the account was assigned from PayPal to Lowell Portfolio Ltd on 15-09-21. The Defendant does not recall receiving notice of this assignment."

              Should I put "claimant" instead of the name of the claimant?

                  No, it should read Lowell Portfolio Ltd, which is correct.

                  So you're all set to lodge your Defence through MCOL.

                    Yes. The 28th day is 20th (Monday) so I will lodge Defence through MCOL today.

                    Is it also necessary to post a copy to Overdales today?

                      I think it's a 'good' idea, at least you know they've got it.
                      Post it in the next couple of days.
