Perch Capital/TM Legal/County Court claim for CCJ/Trial 12 September - advice please!

    Just to update, Perch unfortunately won on 12 September and now have their CCJ. Have been waiting 6 weeks now for them to write and let us know their intentions going forward and if they are going to keep their word and apply for a charging order.

      If you are not going to pay then you should assume that they will apply for a charging order at a time of their choosing. You are not in a position to dictate when this will be.

          You need to visit your local CAB office, don't wait for them to write to you.

            Thanks echat11 I am inclined to wait until I hear from them as there is no time limit on the CCJ and their intention previously was to apply for a charging order which I accept as long as they don't try to force a sale of the house.

              The thing is it's difficult to get appointments with CAB, at least you'll have contact if needed, who can act straight away, put forward the health issues etc.
