    Hi, Sorry if this not the right place to ask for help with this. Not posted in anything like this before so please bear with me.

    I have received a county claim court pack from Moriarty Law. They are telling me I need to pay an unaffordable (to me) amount of approx £65 a month within 10 months of receiving that letter or I will be issued with court proceedings no matter what and obtain a CCJ. I have offered to pay £44 a month and they have refused - originally was a £250 debt. I have never received any correspondence from the party the debt was sold too then being sold onto this Moriarty Law so have asked them for the evidence of the letters.
    Just to receive a county court claim form out of no where after forgetting i even owed this money made me get onto trying to sort it straight away,.

    Is there anything I can send them to get them to listen and let me pay what I can afford. I don't think £44 a month when I am already struggling financially is unreasonable. They haven't even asked me for my income /expenditure. Just seems a bit bullyish (if that's a word) to me. I can copy the correspondence so far from my emails but don't want to overload and put to much detail in my first post incase its too much and no one is able to help.

    Firstly don't speak to them over the phone.

    a) Fill in an Income and Expenditure Form, make sure you take account of the cost of living (you'll need to work out what costs you'll have in the future i.e. utility, food, etc, so you cover yourself. Don't say you'll pay £XX, when next month you can't).

    b) Send the I & F with the following template (amend it to suit your situation). Make sure you get Proof of Postage.

    I'm assuming it's a non - priority debt, if it's £1 a month, so be it. A Court will only ask you to pay what you can reasonably afford, if it's £1, so be it.

    Update when you get a response.

      Your first post suggests that you have received a county court claim. If that is correct, you need to respond. Follow the guidance in this link:
