    5 year ago - parking fine - county court - please help

    Hi, my partner has just showed me that he has received a letter - claim form from County Court Business Centre from 06/11/2016.

    The fine is from when we visited pets at home. He stayed in the van while I nipped into pets at home with our dog.

    They're now after £331.84 is there anything we can do to fight this parking fee or should we just pay it?

      That is not a letter. It is a formal County Court Claim Form. It is not to be ignored: your partner needs to act promptly to:

      Acknowledge service: https://legalbeagles.info/library/gu...ledge-a-claim/

      File a Defence: https://legalbeagles.info/library/gu...-court-claims/

      If he does not do these things in time, a County Court Judgment (i.e. a CCJ) will be entered against him.

      Others will no doubt advise on the other aspects of this.

          Hi Atticus,

          Is there any defense in the fact that he didn't leave the vehicle or stop the engine running? Or in the age of the fine?

          If not, I'm unsure what other defense he would have so assume we would need to pay the fine?

            I would be looking at other things, which others may be better placed to comment on. Leaving the engine running unnecessarily is not a defence, to my knowledge.

              Are you able to upload a copy of the letter please? If it's from 2016, it may not be a claim form but a County Court Judgment. They have to send you the claim form within 4 months of issuing the claim, so if they have only just done so, it may be invalid. However, without seeing it, I can't advise.

                    It is a claim form. I'm afraid I was unable to open it but I could just about make it out from the small image I could see.
                    What is the date of the claim form? You need to respond within 14 days. Are you able to upload as a PDF please?
