  • CCJ Civil Enforcement change of address - which way to go?

    Hello,

    I know this situation has been asked many times but I wanted some clarification.

    Usual story - found a CCJ last Saturday 19th March, phoned the court Monday 21st March found out what it was (parking fine from July 2019) served to an old address (2 years old) and I had moved twice - electoral register up to date at all addresses and DVLA partly updated.

    I have no recollection of the parking incident, nor hearing about it albeit I don't deny it happened.

    I issued a SAR to Civil Enforcement on Tuesday.

    Wednesday 23rd a work acquaintance at a legal firm offered to send a "without prejudice" offer to clear the original fine on the basis they consent to a set-aside - this is being done as a favour so I haven't really pursued this at this stage.

    Today 24th I phoned Civil Enforcement - out of curiosity I asked them what effort they made to find my address before issuing the CCJ. They said they checked my address against a credit reference agency on 2nd March 2020....I asked why not check before issuing the CCJ and the girl replied "they are only able to check once" bonkers.

    I understand I have a really good chance of having this set aside without consent but I don't think I have the mental capacity to do everything that is needed, I understand that sounds incredibly weak but it's the truth.

    They have agreed to consent, providing I pay the original charge and once done they will issue a consent order stating it has been paid - obviously this concerns me but I'm not sure unless I fight this which way to go?

    Am I shooting myself in my foot by accepting their offer? It seems they have me by the short and curlys.

    Oh as a side note - I finally became 6 years free from my bankruptcy October last year - so this is highly sensitive subject for me, the prospect of being crippled again for another 6 years
