I've requested the credit agreement from hoist as a c/o their solicitors using the template and they replied:
"Please be advised that your comments have been duly noted. However, as the above Claim has been issued, you are required to formally respond using the response pack as you deem appropriate.
You are now required to respond to the response pack by x. Therefore, please complete and return the form to this office by the said date. Failure to respond may lead to Judgement being entered against you by default, which will incur further costs which you may be liable to pay.
Please note if you still require copies of the original credit agreement, this can be requested within your response.
Upon receipt of your response we will then refer this to our client for their instructions.
We trust this clarifies the position and look forward to receiving your earliest response"
I replied
"As per my original email, the request is for a copy of the credit agreement. Formal acknowledgement of the claim has already been made via the Moneyclaim website."
And they have responded again with
"We understand you are requesting copies of the credit agreement for this matter. However, as previously stated, you are required to formally respond to the Claim Form as you deem appropriate. If you are still requesting copies of the agreement, this can be included within your response."
Are they trying to be awkward? Surely if I request the credit agreement then any other paperwork is irrelevant as I'm entitled to it by law?
