im looking for some advice, I have recently received a claim form (claimant is KBT cornwall / Amtrac / BW legal) in the county court business centre Northampton, the dispute is over a parking PCN dated 23/12/2019, over the last 2 years I have received many letters, phone calls and a reply form they sent, asking if I agree I owe the parking fine, I’ve not once admitted I was the driver, but did agree that the only money owed was the £6.50 to park, my disagreement is because on the day of parking I had no change for the parking machine, but was able to pay for my parking with my bank card, I put my card into the machine, put my registration number in and how many hours I wanted to park, the total was £6.50, I entered my PIN number and after a couple of minutes the ticket dropped down and removed my bank card, I put ticket in the window of my car, on returning I had a PCN, I couldn’t understand why, I didn’t realise the ticket that I put in the window of my car was a void transaction (printed on same paper as parking ticket) as the machine had network failed, I didn’t look at the ticket when I put it into my window as I knew the time we had to be back to the car before ticket ran out, i did write them a letter explaining all this and said I was happy to pay the £6.50, as that is what I owe, I have kept all correspondence to and from them including the original car park ticket and the PCN, I feel the car park ticket machine was at fault, I have never and would never not pay to park my car, do I just give up and pay the £258, or should I keep arguing it, I know I have a limited time now to respond to them, my other question is if I argued this and it went to court, I wouldn’t be able to attend, the car park in question is in cornwall, I live in cornwall and the claimant KBT are based in cornwall, yet the court is in Northampton, any advice would be gratefully received.
