  • County Court - Tomorrow

    Seeking some last minute help!

I have a hearing tomorrow morning against Mortimer Clarke for an old Vanquis debt.
the debt itself became statue barred in July last year, but because they’d started their court proceedings just a matter of weeks before means I’m now having to fight it!

I entered mediation and was available for this, MC however never took the phone call. I was advised they’d reschedule, never had anything else until a letter arrived saying that a hearing is taking place.
MC constantly sent communications to an incorrect address despite advising them several times of my correct address. Fortunately I was handed the letters otherwise this Claim would have gone through without me knowing!

is there anything I could be missing for a defence? I requested the
Original agreement, Statement of accounts, Default notice , The Deed of assignment, The notice of assignment & not all of this has been provided.

Any directions would be greatly appreciated
