  • Lowell vs Tmum21

    So I've had a claim form today...
    Lowell have put a claim in for 3 different accounts, 2x capital one and one an old very account. I payments since I lost my job January 2018.

    What do I need to put when I acknowledge the claim?
    I don't have any dispute other than I stopped paying very when I returned an item and they didn't credit my account, so did it manually but didn't take off the interest.
    I told cap one I lost my job and they didn't freeze my account so a few charges went on.
    I've seen the thread I need to request the CCA & CPR.
    Panicking a bit I can't cope. With a ccj

    Sign into MCOL using data on claim form just tick defend all that gives more time then come back here once submitted

        Issue Date: 11/06/21
        Amount approx: 3700
        Claimant: Lowell Portfolio I Ltd
        Solicitor: Overdales
        Original Creditor: Very, Capital one, Capital
        Particulars of Claim:
        1) The claim compromises of the following agreements the defendant entered into:
        a. Shop direct Financial services with reference xxxx and current balance of £500.
        b. Capital one europe with reference xxx and current balance of £2000.
        c. Capital one europe with reference xxx and current balance of £620.
        The agreements were terminated as payments were not maintained and subsequently assigned to the claimant.
        And the claimant claims:
        a) the total of the said sums being £3200
        b) Interest pursuant to s69 county courts act 1984 at the rate of 8% per annum from the date of assignment to the date of issue, but limited to one year, being £250
        c) costs

        Is the debt Statute Barred? No
        List any letters you have sent: I have had no contact with the claimant at all, I sent the CCA request to Lowell and CPR request to solicitor on 18/06 recorded delivery, had no response as yet.

              Yes, it's allowed. It will just mean a longer, slightly adapted defence.
              How old are the accounts, i.e. when were they opened?
              "Although scalar fields are Lorentz scalars, they may transform nontrivially under other symmetries, such as flavour or isospin. Most mesons are pseudoscalar particles." (finally explained to a captivated Celestine by Professor Brian Cox on Wednesday 27th June 2012 )

                The shop direct 2016. The 2 capital one accounts maybe 2017. What do you reckon my chances are?

                  Still worth doing those CCA's but don't have high hopes that the agreements will not be found. It buys you some time to look at finding a settlement proposal. We saw a settlement reduction on another thread of 7k down to 4.5k for a lump sum, even though the agreements were all in order. I think its because the courts are so back logged they know they'll have to wait over a year otherwise. If you carefully follow the process and need time to get some money together, the delays can work in your favour....although remember the s.69 interest will accrue to a max of £250.

                    The agreements will all be electronic so I imagined they will find them with them only being 4/5/6 years old. I'm a student (I'm 39 with a child) would this work in my favour do you think for settling. I'd have thought they wouldn't do a deal as court would grant them the full amount. I finally got most of my things in order, I want to get a mortgage asap when I qualify I cant be doing with a CCJ

                      If you read around a few other threads, good settlements are being offered. I guess the best idea is to set out your situation in writing via email explaining any relevant issues and see hay they offer. Don’t make them an offer as yet just ask them to give you settlement figures for monthly payments and a lump sum to see what the difference is.

                        So far I haven't heard anything back. If they did a payment plan with me would they stop the court action? I thought it was too late for that. Had a look through some posts. Frustrating when people just stop commenting and I wonder what happened! Thanks for your help it's much appreciated
