    Hi, I'm considering defending my case.

    basic outline

    I parked my vehicle on a trading estate and used one of the businesses. There was a sign displayed, it stated not to park on verges or roadways or you will be issued with a fine. My vehicle was parked in a marked bay. When I returned to my vehicle I had a Parking Charge Notice stuck to the screen. I sent the below as a hard copy and email 5 days after i received the ticket. I have a picture of the original sign, but not of my vehicle parked in a space.

    "You issued me with a parking ticket on 05/01/2019 but I believe it was unfairly. I decline your
    invitation to name the driver, which is not required of me as the keeper of the vehicle. I will not
    be paying your demand for payment without prejudice for the following reason.

     The alleged contravention did not occur
    Your signage clearly states that “VEHICLES MUST NOT PARK ON THE ROADWAY OR
    VERGES”
    The vehicle in question was parked within a marked parking space whilst the driver of
    the vehicle was using one of the many businesses on site.

    If you choose to pursue me please be aware that I will not enter into any correspondence and
    this will be the only letter you will receive from me."

    This all happened in 2019, and I've only ever received letters from BW Legal, nothing from my contact to NTC.

    Any advice would be greatly apreciated.

    So post up the original PCN and images of the signs. Use a hosting site such as imgur

    Edit so that the identity of the driver cannot be inferred.

    Acknowledge the claim using the details and password on the form 5 days after the issue date,or shortly after. This gives you 33 days from the issue date to get your defence to the court.

      I can't find the original PCN, I have requested a copy.

      From what I can find on NTC site and that of the "governing" bodies, my appeal is supposed to be accepted or rejected, and then communicated to me. Either way I never received contact after either of my appeals was sent.

      This extract is taken from NTC website

      "Postal appeals are not preferred but will be accepted in writing to this address: NTC, Sackville Business Centre, 44-48 Magdalen Street, Norwich, NR3 1JU.
      Please clearly state your reason for appeal and detail any other information you feel is relevant. This must be done within 21 days of the enforcement action or the appeal cannot be heard or within 14 days if you wish any discounted payment to be honoured.
      Our appeals department will respond in writing or by email within 14 days with a decision. The amount out-standing WILL NOT increase, whilst we consider your appeal. If your appeal was received within the discount payment period, the opportunity to pay the reduced charge will be extended, after a decision has been informed.”

        NTC have supplied a copy of the PCN and images taken at the time.

        they show the car parked between lines in a parking space, the PCN states the ticket was issued for “parking in a restricted area” which clearly isnt what the signage informs.
