    Hi All, lm new to this forum and just finding my way around!
    l'll get to the point, basically we took GE money through mcol, and four days later they took us through mcol. They put in a defence saying that the charges/ppi were lawful blah, blah!
    Anyhow we were consumed by putting in our defence for their claim which we did on line stating our terrible financial situ etc, addmitted to part of the claim (ie for the goods plus interest not the charges and ppi) and offered £10 per month. We didnt hear anything for a while and the next thing we know is that a letter arrives saying as you know a ccj has been entered against you therefore you will have to pay £125.00 per month as the courts instruction? There was no reply to our defence or offer. Now we have been sent an allocation questionaire to go to our local court for a hearing, but CL finance seemed to have totaly ignored our defence.
    Shall we just put our letters together and see them in court, are they lightly to turn up. Also do you think they're lying about the ccj as we've had no notice of this, we phoned northampton and they said nothing had been registeed with them.
    Phew!!
    Any help really, really apprieciated. (l think l've spelled that right!!)

    Who did the letter about the CCJ come from? Was their claim against you a counterclaim or a separate claim?

    A defence isn't really the place to air your financial troubles and make an offer of repayment.

      Hi Amy, thank for your reply, this was a separate claim, not a counter claim, sorry l have'nt made myself very clear have. The defence did contain a defence, it was as we worked our way through the procedure on line we had to fill in section 11 about i/e and they ask you to make an offer.
      No offical word from any court about ccj only the letter from Cohens begining with "as you know you have a ccj entered against you"

        When you submitted your defence, did you print off the confirmation page?

        I'm still a bit confused. Which claim is the AQ for - their claim or your claim?

          The AQ is for their claim against us, oh dear l dont know if we printed off the confirmation, we did the defence and printed that off, (filled in the defence right the way through as l said before) is that what you mean.
          We're confused too! We're going to find out if a ccj has been registered at our local court, then if it has when we go to court we'll be asking to see proof of delivery as we've not had anything as far as we're aware. Would they send notice of a ccj via recorded delivery to make sure the person knows about it, because if this is the case this is what cohen's have not done.
          They dont seem very nice people.

            Well I fail to see how they've obtained a CCJ against you when it's only at AQ stage.

            You can still check what you did online with MCOL. Use your log-in details that came on the N1 court form they sent to you and check it from there.

              Thats music to my ears! Thats what l thought, l know lm not an expert but reading and re rereading procedures l could'nt see how they got to that either, you can see now why its confusing the issue.
              Right, so if we send the AQ back and actually get as far as the court room would l be right in thinking that this letter they sent us actually saying we had the said ccj, wont look very good for them, as they've told a porkie have'nt they. My OH will be dealing with it if it gets that far and luckily He's not easily intimidated but what about people who are, it's very worrying.
              l just want to make sure l have the facts right for him so if needs be He's properly armed!! Rather than just go bumbling in!!

                  Yes that's a good idea so OH can refer to it, l dont understand why they'd make themselves look silly by saying they'd got something they had'nt. l was thinking of ringing them to see if we can make an arrangement, but under the circumstances l think we'll just reply to the AQ.

                    CL Finance will try anything on and if you think how many times they do this to people and how many times they get away with it because people don't know any better - they are on a winner.

                    Do not ring them, do not speak to them on the telephone at all. Keep everything to the written word.

                    Have you sent them a CCA letter yet? If not, that's what I would do.

                      l didnt think of doing a cca request as they come across as solicitors (thought you could only do this for dca's) acting for ge money/cl finance whatever they happen to be calling themselves at that time!! We only have to the 16th feb to get the AQ back, but will request cca anyway.

                        Rather than a CCA you'd be better served with a CPR31 request as detailed here: DCA: Using CPR 31.14 to Your Advantage - Consumer Wiki

                        As and when they ignore this you can bring it to the courts attention and they will be in serious pooh.

                          Hi Curly,
                          The thing is this was originally a burtons account, and on looking through my file l do have the cca from them, would a cca request from cl finance be a different thing? Is cl finance a dca then not a solicitors? This is where lm getting confused. Easily done, l might add!!!

                            CL are a DCA whereas Cohen are their "pet" solicitors.

                            WHo have your previously CCA'd about this debt ?

                              Hi, originally got the cca from ge money/burtons when requesting a refund of charges and ppi, thats when they sent it to say see you signed for the ppi.
