  • HELPPPP court claim for parking charge

    Hi guys

please can some one help me!!!!

I received a parking charge at my uni on the 5/12/2019 which I do not remember at all, I don’t even think they stuck it on my window but instead sent it to my house!

I can attach a sanitised version of my claim form too,

the claim form is asking for £153 plus court fees and legal costs altogether £228 which is a lot for me cos I’m a student.

I parked in a car park next to the library called blue zone J
the claimant is first parking llp
and the form says I send documents to DCB legal

i did recieve some letters but I ignored them
to be really honest I don’t even remember anything about it

shall I ask for all the evidence? I feel like saying that I didn’t recieve anything ....

Edit so that the identity of the driver cannot be inferred. The driver drove and parked, the keeper received everything and is handling

So if you have the initial letter then post that up, suitably redacted but leave dates

So what is blue zone j?

I didn’t get a letter about court before this,

I have my letter that the court sent, I’m not very familiar with this website I’m not sure if I. Had attached the letter but if not I’ll attach it again.

The blue Zone is staff parking at my university there’s a camera which usually picks up someone entering and leaving the car park

I really don’t even recall that day and I defo don’t remember receiving it on my car.

should I contact the car park company to ask for more info or claim I haven’t seen this before? It also says on the letter that I agreed to pay previously which again I don’t recall either. I don’t usually contact these companies

Need to see the original PCN you received

Have you acknowledge the claim using the details and password on the form? Nothing in the defence

That’s the issue though as I don’t have the original PCN as it was around two years ago I don’t even remember getting one
and I have gone onto it yes but i haven’t acknowledged it as of yet

So CPR 31.14 request to the solicitor to get the documents. Request the PCN, photos of the signs at the relevant date and as their client cannot be the landowner a copy of the contract that allows them to charge and take court action.

            SAR to the parking company.

I don’t have a solicitor and when I did email DCB legal they said they were not obliged to provide me anything as it’s already a court matter

So write back to DCBL and ask why they believe they are exempt from CPR as the claim has not yet been allocated to track

Also complain to the Solicitors Regulation Authority about their behaviour

Prepare your defence and state that the claimant's solicitor has refused to supply information despite a CPR 31.14 request. You ask the court to order that the documents requested be supplied and you are permitted to amend your defence with the cost being met by the claimant.
