  • Noddy v Lowell judgment + charging order

    Hello everyone I'm looking for help and advice.
    Over ten years ago I defaulted on 2 credit cards from capitalone. I advised them but couldn't keep up payments I was taken to court and couldn't afford the payments. The debt got passed to companies who refused to accept an affordable payment or provide proof of claim. At one point 3 companies claimed this debt in 1 year. I found out about an attachment order on the house which I'm attached to with the buyer. And have been contacted by Lowells who I believe will take this back to court after 10 years. I did try to pay capitalone directly and they refused to accept any payments. I've had little contact in years (atleast 4) about this debt till earlier this year (2019) and have offered payments in the past. The house I live I've never considered to be mine as the buyer isn't looking to sell and claims it's hers. I'm unemployed and have been over 6 years. What can I do?

    So you've received a judgement against you for this debt which has been enforced by a charging order on your home?

    What was the last letter you received about this debt?

    How is the property registered at the land registry? Is it a joint mortgage or only in one name? And do you live at the property?

      I was added to the mortgage yes but after purchase when the buyer(a relative)insisted. I assume the Land Registry indicates my name. But have not checked as I can't pay the fee.I received a letter from Lowell 3-4 months before June. But they had just received it so wouldn't clarify details beyond amounts. And was told to expect correspondence in 10-14 days? I've received nothing since.

        The Mortgage holder(Bank) confirmed the charging order application but no other details such as if it was applied.

          The charging order was applied for at the very beginning. Even though cooperation was forthcoming and no refusal what so ever to make payments.
