    Advice re Lowell’s

    So I have received a letter from Lowell’s following my submission of defence inviting me to complete the mediation directions questionnaire ( I’ve not received one from the court just Lowell’s copy or They have invited me to contact them and offer a settlement, so do I offer a settlement if so how much the debt is £1680 but they have added all the court costs and interest now making it just under £2000 have opposed Lowell interest in my defence or do i just agree to court mediation as really don’t trust Lowell

    You should agree to mediation via the DQ anyway.

    Whether you try to negotiate a reduced settlement directly with lowell ( to be set under a Tomlin/consent order https://legalbeagles.info/forums/for...-credit-claims ) depends on the facts of the rest of the case - compliance with the cca etc. I'll see if I can find previous thread.

      Last payment Sept 2012? Have you got a copy of the default notice ?

      They provided a handwritten agreement ? Does it contain all the relevant terms ?

      The £1600 is interest and charges ?

      Acknowledge Claim - within 14 days from Service

      Defend Claim - within 28 days from Service (IF you acknowledged in time)

      If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
