  • Hello!! Littlewoods/Lowell problem

    Hello,
    Today I got a letter from Lowell solicitors. I have severe diagnosed mental health problems. At the time of allegdly debt I had a breakdown and was admitted to a mental health facilty.

    they have been harrasing me by phone many times a day.

    can anyone tell me how to respond to this county court claim form please?

    Have you communicated your health issues at all to Lowell previously?

    Is the letter you have received today an actual claim form from Northampton County Court Business Centre ( claim number top right of page?) or is it a ' Letter Before Claim' from Lowell with a reply form attached?

    Any idea what the original debt is?

      Hi, they are saying the original debt is for a littlewoods account. Original figure £370, with costs they want £500.

      no I have not told them about my health problems.

      Yes the letter is a county court claim, should I contact Lowell or the court?

        Hello I sent in my defense to the county court, i have received a Direct questionnaire, but it the contact details is has lowell's Solicitor details.

        i now have been sent a "notice of proposed Allocation to track which specified the date by which you were required to return the DQ. You have failed to file the DQ with the CCBC by the date specified in the notice"

        What is this???????? Can anyone tell me how to proceed PLEASE!!!!!!!

            File your directions questionnaire. Did you not get one from the court at all before? only one from Lowell ?

            Regardless you do now need to file yours ( and send a copy of it to Lowell at the same time) - there's some help here >> Directions Questionnaire

              Hello today i received this letter from the county court. I entered a defense under mental health grounds.

              How should i proceed here with this matter?

              Is it too late to notify Lowell's with a notice of vulnerability?

              Should i write to the court and try to explain my situation?

                You should complete the Directions Questionnaire - and send it to the court, with a copy to the claimant. There is some info on that here - Directions Questionnaire

                Really it's just a procedural document and no one at the courts yet has actually read the claim or the defence, that comes once it is at your local court.

                  so sorry i've i stared a new thread in another section of the forum because i thought it was gone beyond Lowell's and did not think anyone might see this!!!! so sorry i tried to delete before posting but it didn't work.

                  There is a letter here, Direct Questionnaire, to be completed on behalf of Lowell's .

                  A. Mediation. box sent to me ticked yes. (pre filled in)

                  B. Your contact details : Has Lowell's contact details

                  C. Track. Also sent ticked yes.

                  D. About the hearing.

                  D1 Venue ,blank

                  D2 Expert evidence, ticked no

                  D3 Ticked no

                  D4 ticked no.

                  I never returned this form to the court.

                    That's okay am merging things together for you xxx

                    Lowells do send you a copy of their directions questionnaire ( which is what the one you have detailed above is) and sometimes tell you to fill one in too... however you SHOULD have received a letter directly from the court asking you to complete the DQ... it sounds like that letter went astray.... no harm done, you just need to complete the form now. You would basically say the same as Lowell have said anyway, just with your details and putting your local county court in the venue box.

                        No you need to do a separate one, print this out - https://assets.publishing.service.go...6/n180-eng.pdf - and fill it in with your details and send that to the court ( and a second copy to Lowell ).

                          Yes this is the form sent filled out by Lowell's does this mean they want mediation with me?

                            Yes, it is usual to agree to mediation so you have opportunity to settle before it gets to a court hearing xxx Don't read too much into it... very little thought has gone into it on Lowells part.

                              Once you have filled in and sent back the DQ let me know, and we should have a look at the rest of the case, and if you should notify Lowell of your health issues outside of the court claim. Do you have a copy of the defence you did enter ? and the original particulars of claim on the court form they sent at the start ?
