  • Lowell Fraud and settlement refund - should I accept?

    Today I received a letter I’ve been fighting for over a year to get. I’ve been fighting a fraud case since January 2018 which has been a nightmare to deal with. I have spent entire lunch breaks in Citizens Advice, had to open a Police action fraud claim, reported Lowell’s to the financial ombudsman, evenings writing countless letters back, and calls on hold to various people for hours in total explaining it’s not me. That didn't work.

    The file I have for them is big. Also important to mention, whoever opened an account pretending to be me had a strange email address and moved addresses numerous times in London (never lived there) and opened it with a Delta card (never had one). Despite all of this they opened a Court Junction against me, bailiff letters were sent and it affected my credit rating a lot. I recently had to threaten with taking my own court action and getting my own solicitor. It’s only now they decide to send me an apology for all the stress and a cheque of £250. This morning I received a normal looking Natwest cheque for £250. Friends have said not to cash it as it could be a test of some kind. But also that £250 is a low amount and they know that if I took them to court it would cost them more given all the stress they have caused me and all the time I’ve put into letters. What should I do? Accept the money and cash the cheque and be glad I have a letter stating it’s over? Or leave the cheque and write to them saying I’m not happy with the result and say given the amount of time and hours put into calls, and writing to them that there should be more or I will be taking it further with my solicitor (which is rather not do but maybe threatening that could work)?

    Any advice is very much welcome and appreciate it because I’ve spent the last year totally lost as to what to do. Thank you!
