    Hi everyone, i received a letter 3rd jan staying (notice of issue of warrant of control). I binned it because it was not official court paper nor the correct colours and it was not stamped and arrived in white envelope. Then i’ve received a (final notice) allegedly from HMCTS on white paper, not stamped which states a warrant has been issued and unless I pay, I leave them with no other alternative but to send bailiffs.

    I have checked my credit file and the CCJ number on both letters match one which is showing on my file, but the balance is different? CCJ £629, warrant? £179? The CCJ was filed in 2014 for an alleged account with them opened in 2013.. I have no clue what for, I have lived at a new address for over 4yrs now and this is the first info I have received on this matter so i’m completely confused. Lowell are calling me every day since 10th jan regarding (the letter they sent me 3rd jan)? I thought the courts would have sent that? Now i’m completely confused and would like some help working out what’s going on

    So because in your opinion you thought that the letters arriving on white paper meant that they weren't official court paper? What is official court paper, because I certainly don't know what it is. As we haven't seen these documents we can't tell you if they were genuine or not but what is more surprising is that you thought (I'm assuming here) at no point to contact the court and confirm if the letters you received were genuine.

    The court doesn't always send to you letters or applications or notices on behalf of the claimant, they can opt to do that themselves. If you want to work out what's going on, then the obvious thing to do is call the court and find out, which is what you should have done in the first place!

      You do not need to be so rude, I called the number on the second letter and it’s a dead line. I then came online to look for information and I discovered this site, hence my post. I am calling the court and anyone else I need too this morning.

        Is it Lowell ? There will have been a judgment in default made against you ( maybe at an old address ) where the order was to pay by installments, possibly an old mobile phone type account going by the amounts. Lowell have done this quite a bit in the past - I don't pretend to understand why but presumably to encourage engagement. It is odd they only issue a warrant for one installment plus costs though if the judgment was in 2014.

        When ringing the court ask them to email you the claim info so you can look at an application to suspend the warrant and set aside the judgment. Certainly ask them the date of the judgment and the address the claim was issued to. You may then have to contact Lowell to find any more out. Set Aside Application

        The courts phones will be busy this morning ( they had a bad week last week with IT issues ) so if you can, I'd wait till this afternoon. Try Northampton business centre if you can't get through to the issuing court, as it is likely the judgment was issued there. ( Northampton ccbc 0300 123 1056 ).

          Yes the judgment was issued at Northampton for £629 in 2014. The letter that speaks of a warrant for this judgment only requests £179. I assumed the balance on the CCJ would match the letter from HMCTS because the reference numbers do.

            I’ve been with o2 since I was 17, I am 34 now and I still have the same mobile number as I have always been on contract. I’ve just checked my credit file again and Lowell are showing in my closed accounts section for amount of £629, it’s showing a telecoms icon next to Lowell’s name..
            I care full-time for my disabled son so my income is basically weekly care allownence! I don’t have £179 to pay by 30th Jan. I’ll look into having this set aside today. Thank you very much for your advice Amethyst. I really appreciate it.

              I'm sorry if you feel that I'm being so rude about it, but I would have thought that's the first thing any reasonable person would have done. You chose to bin the letter and ignore because you thought it didn't look official enough in your view. Anything that comes from the court should be taken seriously and not binned in the first instance simply because you think it looks unofficial - the only way you'll know for certain is to call the court.

              I was simply expressing my surprise at your actions of binning a document that potentially came from the court (or indirectly through the Claimant) and your entitled to your opinion as am I.

              As I mentioned in my last post, there is no real official court paper that I am aware of. Usually, documents and letters sent by the court will be issued on re-cycled looking paper but that doesn't mean that the court can't send official letters on white paper or in a white envelope.
