CCJ received, amount very different to the debt

I received a CCJ for a debt of around £1300, the claim form only asked for £25.41.

As this has now gone through the courts. once I pay can they come after me for the rest, or has someone in their administration messed up to my benefit

The payment is forthwith, as i never received the paperwork work, and only got the ccj notice from a neighbour of my previous address

I was taken to court over a debt by the current owner of a debt i am liable for, the debt amount above. how ever when i recieved the ccj and the amount the court said i have to pay it was a lot less than the debt, i called the court to confirm, i've called the debt owner to make sure i dont have any other accounts with them which they've confirmed, only 1 account.

The debt owner says my debt is 1300 the court says i have to pay 25.41. It seams to appear that someone has messed up before the court issued the ccj, i just don't know where i stand on it.

Bizarre- I know Asset are a bit rubbish - but I don't think even they would sue someone for 41p.

£25 is costs - so the judgment is for 41p.

Did you actually get the original claim form ?

unfortunately no, i don't have the original claim form, i do how ever have on mcol an acknowledgement of service, so my statement in the beginning of never receiving paperwork is a lapse in memory on my part, i've just turned my flat upside down looking for the claim form but it must have gone when i moved

Okay no you didn't.

In the morning can you give the court a call at Northampton CCBC ( give yourself half hour to get through ) and ask if they can email you the claim details as you've just received a judgment in default that you hadn't received the claim form for previous. They'll need the Claim number and SHOULD be able to email you the details, although sometimes they will only post it and charge a £10 fee (grrr). But if they do that you could just ask them how much the claim was for on the original issued claim.

Basically you want to know if Asset cocked up and did enter a claim for 41p( get it paid lol) or if the court has made a typo ( in which case Asset are likely to get it corrected - and you'll then need to go through set aside to be able to defend the claim )

Ahhhh oops. Okay it happens... Still give court a ring and say you didn't receive it so you can get a copy.

Mind you, if the claim WAS for 41p and you had seen it at the time, you might have paid it straight away lol. SO I suspect it's a court typo error or Asset when they put through the Default Judgment request.

So don't count chickens just yet xxx

Theoretically, but when you pay it they are likely to notice the error and depending on who made the error, possibly ask for it to be corrected. If it was that the claim was brought for 41p they'd have a bit of explaining to do to the court to get it amended, and you'd have opportunity to defend the case I believe.
