I hope someone can help me. Back in 2014 I started getting letters from Lowells for a debt I did not recognise so
I rang them and asked for details and proof that I owed this debt (it was for a catalogue) they said they would send
me documention. I never got anything from them but continued to bombard me with Letters for the next 4yrs which
I ignored.
Last week a bailiff turned up at my door to serve papers on me. It was an attachment of earnings for a CCJ which
they said was actioned in 2016 for £50 a month. I knew nothing of this as never had any court papers. I contacted
my local court who said they would send me a copy of the form and a form to have it set aside. They also sent me
a form to fill in, stating my income and said if on low income fees could be waived.
I filled it in and sent it back as I do not work as I am in my 60's and am supported by my Husband who is retired
so we only have his pension and pension credit to live on.
A day later I got a letter from the court to say my application to have the fees waived was rejected and if I wanted
to apply to have the judgment set aside I would have to pay £255. How can they turn me down when I do not earn
anything and am supported by my Husband?
I cannot afford to pay £255 as we only just have enough to pay bills and eat.
Lowells have said again they will send documentation regarding this debt but am still waiting for this.
I have since been told that Lowells pay Northampton County court business centre to issue judgments
without giving the other side a chance to deny it. I do not know if this is true or not.
Does anyone know about this and can you give me any advice. It is making me ill with worry.
We rent our home, only have my husbands pension so have no means to pay this and do
not see why we should when I do not owe it. I would rather go to prison than give them a penny.
