    At 9 you should put what they have sent you and why it is pointless - you should also positively state that you did not have an account with orange in 2014 and the address issue. Ie. Demonstrate that it is necessary for the claimant to provide the documents as you dispute the debt in its entirety.

    Have you sent a SAR to EE / orange ?

      9. Lowell’s Solicitor has not sent any of these documents to me, only a letter confirming receipt of request for details relating to the account

      15. To my knowledge I did not enter into an agreement with Orange in 2014. I therefore require the claimant to provide me with any documentation as I dispute this debt in its entirety.

      I'm unsure what you mean by address issue. SAR has been sent.

        Me neither reading back - I thought they'd sent a statement with an old address on ? May have been another thread sorry xxx

        so 15 ( I think I'd put it higher up - around para 5 )

        Have the claimant's mentioned 2014 at all? I know their particulars of claim fail to say when the agreement was entered into - but on the pre-action info have they mentioned 2014 at all or that something you only know from having spoken with Orange/EE ?

        15. To my knowledge I did have not entered into any agreement with Orange since 2002, which ended within 18 months and was closed without any outstanding balances. I am not aware of having entered into any further agreements with Orange since that date. I therefore require the claimant to provide me with any documentation as I dispute this debt in its entirety.

        9 - they said they'd ask the creditor for the agreement ...
        "We have requested a copy of the notice of agreement ad once this is received we will contact you." so Put that in .... ( I've changed 'notice of agreement' to 'notice of assignment' below but check which it is on the original letter.

        9. Lowell’s Solicitor has not sent any of these documents to me, only a letter confirming receipt of request for details relating to the account and stating that they did not believe a signed contract existed, yet had requested a copy of the notice of assignment from the original creditor.

        10. The Claimant also stated that the agreement was "
        evidenced by phone usage costs, which forms part of the outstanding balance" however they have not provided any details or evidence of these alleged phone usage costs. They have also failed to provide any details of how the balance claimed has arisen, how the contract was entered into, the term of the contract or any terms which led to any termination charges ( if included in the sum claimed).

        11. In order to try find out more information, o
        n 10/11/2018?? a Subject Access Request letter was sent to Orange, asking for any data they hold, and I await a response.


        Just personalising it more to show that the claim is for X because they say so and there is doubt whether this has actually anything to do with you.

          Received a letter from Lowell yesterday, it reads,

          We refer to the matter detailed at the side of this page.

          Please find enclosed a copy of the Directions Questionnaire which we have now sent to the court.

          We have agreed to the mediation in our Directions Questionnaire which may result in settlement, if you agree to mediation, please ensure you tick the yes box in part A1 of your own Directions Questionnaire.

          If you would like to settle this matter directly, our client invites you to put forward an affordable settlement to us either as a single payment or by installments. An agreed settlement would avoid hearing or judgement and also associated costs being added to your debt.

          We recommend that you obtain independent legal advice to fully understand your rights in relation to this claim. You can instruct a solicitor of your choice to obtain free legal advice from a Citizen's Advice Bureau or other legal advice center.


          I have still not received the Notice of Agreement as requested from Lowell or any response to the SAR i sent to Orange / EE
