    Hiya xx

    I've got the letters through. There's no doubt that they would like you to believe they have a CCJ against your wife.

    I'm just going to put some of the letters here to help others who might receive similar. Will do a selection of the emails too. WIll try put them in order.... but probably not all of them lol.

    Dear Mxxxxxxxxxxx,

    As you have failed to complete the relevant paperwork documents enclosed within the Claim Pack, we have requested that a County Court Judgment be registered against yourself. Subsequently, the County Court will write out to confirm a County Court Judgment has been entered.

    A County Court Judgment will be entered on your credit record at the Register of Judgments, Orders and Fines and will remain there for six years. This record can seriously affect your ability to obtain a mortgage, credit card, bank account and even a mobile phone contract in the future.

    In order to get the County Court Judgment removed from your credit record, you must pay the outstanding balance in full within 30 days from the date of the paperwork aforementioned above. In turn, we will notify the County Court that the account balance has been paid in full and they will remove the County Court Judgment from your credit record. Note, this can take up to 28 days for the courts to do this.

    There are lots of ways you can make payments, pick the one most convenient for you:

    If you pay the account balance in full after the 30 days the judgment will remain on your credit record for the next 6 years and will be marked as ‘Satisfied’.

    If you are not in a position to pay the account balance in full, we ask that you contact our Litigation Department on 0330 808 1585 within the next 7 days to look at setting up a payment arrangement. Failure to contact us could result in further enforcement action of the County Court Judgment.

    Our opening hours are Monday to Thursday 8:30am to 7:00pm and Friday 8:30am to 5.30pm.

    We will shortly request that this is transferred to your local court for enforcement action against you. We intend to enforce this Judgment against you by way of an Attachment of Earnings Order which means your employer could be ordered to deduct money from your earnings to pay off the outstanding County Court Judgment.

    This application will add £110.00 of Court Fees to the Judgment amount outstanding. In attempt to try and avoid these costs, we are writing to request you contact us to set up a payment arrangement on your account.

    In order to avoid the above course of action, please contact our litigation department on 01253 523467 (option 2) to discuss the setting up a payment arrangement on your account.

    As you aware we are now managing the above County Court Judgment, which has been legally assigned to TM Legal Services.

    Following our recent letter this is a gentle reminder you have until Friday 22nd September 2017 by 5.30pm to set up a repayment on your County Court Judgment to avoid the application of the Attachment of Earnings and your employer being contacted.

    The application will add £110.00 of Court Fees to the Judgment amount outstanding. In attempt to try and avoid these costs, we are writing to request you contact us to set up a payment arrangement on your account.

    Following our recent letter, you have failed to contact the office to set up a repayment on your County Court Judgment. We are now in the process of contacting your employer to verify your status of employment.

    Once we have confirmed the status of your employment, we will complete an N337 Form (Request for Attachment of Earnings Order) and present this to the court. We anticipate this form will be completed in the next few days.

    After this form has been completed and sent to the courts, we are unable to retract the application and your employer may be informed of your County Court Judgment. Once the Attachment of Earnings has been applied for, the courts will issue you an N56 Form (Form for Replying to an Attachment of Earnings Application Statement of Means).

    You must fill in this form, giving details of your financial circumstances. These include your employer's details. You are required to include your partner’s financial circumstances also. You must return this to the court within eight days.

    Your County Court Judgment is currently pending an application for Bailiff Action via the means of a Warrant of Control.

    A Warrant of Control authorises Bailiffs to attend your residential property to collect monies owed and/or to remove goods to settle the outstanding balance.

    The Bailiff does not have to show you their authorisation before entering your home.

    A Warrant of Control is valid for twelve months from the date of issue. This time limit can be extended by a District Judge.

    The application for a Warrant of Control will add additional fees on your outstanding balance.

    You will be pleased to know that we may be able to accept a settlement figure for the above outstanding balance.

    Please contact the office by close of business today to put forward your settlement figure.

    If we agree to an amount and if it is paid by close of business today, your County Court Judgment will be marked as ‘Satifisfied’, thus impacting your credit file positively.

    Following our previous correspondence, as of today your account has been transferred to our Specialist Enforcement Team.

    The Specialist Enforcement Team are looking to confirm your status of employment, living situation and any assets in order to determine which route of enforcement we may go down. This could result in further fee’s being added to your account and possibly Bailiffs attending your property.

    You still have the chance to arrange payment of your County Court Judgment and in turn, avoid Bailiff Action.

    - We would be willing to accept a monthly repayment plan until the account balance of £298.45 is cleared in full. We invite you to put forward your offer of repayment.

    We require you to contact the office by close of business Friday 17th November 2017 on the number below to action one of the above options.

    As you have a County Court Judgment, it will stay on the Register of Judgments, Orders and Fines for 6 years, which will be affecting your ability to obtain credit. Once the account is paid, we will inform the courts and get the County Court Judgment marked as satisfied. Thus, having a positive impact on your credit file.

    2. We are able to offer you a full and final settlement figure of £267.71 to be paid over 3 monthly instalments, the first payment must be made no later than Wednesday 31st January 2018.

    3. We would be willing to accept a repayment plan of £50.00 per month until your full balance of £297.45 is cleared in full. Again, the first payment must be made no later than Wednesday 31st January 2018.

    Alternatively, if you cannot afford either of the above options, we invite you to put forward your offer of repayment.

Acknowledge Claim - within 14 days from Service

Defend Claim - within 28 days from Service (IF you acknowledged in time)

If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
