It is entirely up to you. I still have concerns over the 'cancellation charge' on the statement being £227 and then a further £700-£800 being added for 'termination' ... plus that you paid £200 then stopped - feels like the actualy debt was the £227 region. Have you tried speaking with Vodafone ( they obviously have records as they have informed of the £10 a week) or emailed Lee at all ?

As a reminder they have produced this as evidence of the amount owed.

You need to find out how they charged that £227 cancellation AND then added a £770 termination charge as well.

Hopefully Lee will be able to clarify this early cancellation charge vs the early termination fee.

You know on this - are those £800 odd figures? looks like it from the figure on the right hand side but just checking. However of course that was reported by Lowell not Vodafone, so who knows when this £700 odd was applied.

Just thinking letter reply wise while you wait for Vodafone to investigate. Lowell have said the account is on hold for 30 days so no huge rush but you don't want them chucking a claim in after 30 days without you having clarified issues from VOdafone first.

                          Dear Sirs,
                          REF: xxxxxxxxxxxxxxx
Thank you for your letter dated xxxxxx 2018 in response to my previous letter. With the additional information you have provided I have been able to check my banking for the relevant dates and it appears that between January and June 2015 I did make payments to XXXXXXXXXXXX with regards the alleged debt which total £200. Entries on my credit file show the account as settled in August 2015, so one may assume that the payments made settled the account.

Prior to your latest letter you had claimed the last payment on the account was £40 paid on 7th May 2012. This would have been made prior to the invoice dated 6th July 2012 which you provided as 'evidence' for the sum claimed, however, as expressed in my previous correspondence the Statement ( copy invoice) you have provided to me clearly states £227 for " cancellation prior to contract end " not "a full breakdown of the airtume debt owed" as alleged in your letter. There is a Service Charge Credit and Admin fee listed for nominal sums.

There has been nothing provided to me that shows a further £770+ charge for termination being applied.

Without any copies of the agreement and terms, and a full statement of the account after the alleged termination fee had been applied I am unable to assess whether such a fee would have been legitimate at that time.

I have absolutely no intention of avoiding any legitimate debt, but I find myself unable to make any settlement offer without further information from yourselves, your clients or indeed Vodafone themselves. Any communication with Vodafone to date has simply stated that the "cancellation prior to contract end" charge on the statement provided by yourselves IS the Early Termination Fee. So I am somewhat still confused.

I am still awaiting a response from Vodafone to my formal Subject Access Request and I will be back in touch once this has been received. I am hoping it will clarify matters somewhat. I would appreciate it if you could keep the account on hold until this information has been received.

Please note I am not requesting information such as the agreement and terms from you at this time pursuant to the Consumer Credit Act but simply so that I may assess my position with regards to your claims before court action is deemed to be necessary. I do not feel requesting information as to how this debt has been calculated, what terms allow VOdafone to have added a further termination fee on top of a cancellation charge and the original length of the contract, payment amounts and any debt actually owed, is disproportionate in these circumstances.

I presume in the letter you have kindly done up for me this line "Entries on my credit file show the account as settled in August 2015" Should have the date 2012?

Ughhhh - my brain is already in holiday mode, can you tell? lol. Yes it is meant to be 2012 and of course that makes the other bit of that sentence obsolete... durrr me. Just checking you were on the ball really xxxx

Not sure if the Account settled will actually turn out to be the default or the sale date as they haven't actually said when exactly it was assigned or defaulted/ terminated as yet - might be an idea to ask that directly in this letter actually.
