      Hi there, can you just clear something up for me regarding your first post


      debt of £149 sold to arrow.
      So Arrow LLC purchased debt from Orange

      i threatend to take orange to court and we then reached an agreement two tears ago that if i paid this ammount the default would be removed and a perfect payment history would show on my credit file, true to there word they did just that.
      You have documantation to prove this dont you?
      Do you have any correspondance from Arrow regarding the settling of this?

      they cut and run and just sell the debt on.
      Why have Arrow got it back then? if they sold it on because they cant get money, they arent going to buy it back further down the line.
      Could it be that Arrow have just been using various DCAs and not actually selling it on?

      General Question:
      If Arrow did buy the debt and the rights to it, then they are entitled to the money.
      But if you paid Orange instead and Orange didnt give the money to Arrow, then in theory you havent settled the debt as the owners of the debt would be Arrow and not Orange.??? And then you would still owe money to Arrow.
      ie Its like you owe Bob some money, and give it to Terry to give to Bob. If Terry doesnt give Bob the money, you still owe the money to Bob

      Have you sent a SAR to Orange & Arrow to confirm the purchase, assignment, settlement of the debt.

      Just make sure all your bases are covered mate before you play with Carter.

        Wouldn't it just be easier to send proof to Bryan that the debt has been paid direct to Orange and get rid of him? Or do you fancy the sport of Bryan baiting?

          hi people

          to answer your questions, yes i am bryan carter baiting.
          so far this account has been through five dca. every time i explain but they wont take no for an answer and just pass it on. this is now going to end.
          as well as the letter i also have my bank statement as confirmation.
          these people need to be stopped.
          this time i have had no contact with fredricksons/carter. i have totally ignored them.
          at the end of the day, the debt has been paid and its up to the dca to confirm they have all the correct information before they start legal action.
          by the way i have never received notice of assignment etc.
          this matter is costing me time and money, for which carter will pay pluss comp

          this little toad has picked on the wrong person

            It could go against in court that you have not tried to resolve this by providing BC with the evidence you have.

            Personally i dont think you would win a compensation counterclaim, as it would appear to the court that you have witheld information just to win compensation, and that the whole case could have been avoided and not wasted the courts time.

            As fun as it is to bait mr C, the Judges very rarely see the funny side in their time and courts resources being wasted.

                Lets wait and see what response BC comes up with when you submit your defence to the Courts. I bet he will back down when faced with facts. He always backs down any time he is challenged

                  just updating

                  after the exelent advice given, i have sent a letter today to brian carter by sd.
                  ive given them the full facts and documentation.
                  this will now cover me if it goes to court.
                  i have also made a request for the notice/deed of assignment under the cca with £1 fee.
                  lets see what that brings forth.
                  i have also stated i am making a complaint to the sra and the oft on how they have handled this and require a response from them by there complaints department.
                  going to make them sweat a bit now.
                  the thing is i could have ended up with a ccj by default, they have never confirmed my address. for all they new i could have moved.
                  will keep you informed

                    I dont blame you for Carter baiting, they put me through 4 years of hell for a debt I did not owe, took them to court and they did not show, called them to court again they dropped the case the day before the case. I demanded my expenses paid back plus compensation, they had the audacity to attempt to send me a cheque,(from Fredricksons???) for £200, sent back to them stating that its an insult to my inteligence, now got solicitors dealing.
                    These cretins need to be struck off. STICK TO YOUR GUNS AND TAKE THEM FOR AS MUCH AS POSS.
