  • CCJ Registered What To Do Now

    Hi, hope this is the correct place to ask.

    My partner has had a CCJ against his name and he has received a letter asking him to pay the full debt in one go (£276)

    We have no way of paying that as we are on JSA.

    What are our next steps? I have read elsewhere he needs to send a form to the court apply for instalments, but we don't know which form or if thats correct.

    Any help appreciated as this is all confusing and we both suffer from depression and anxiety so really need to get it sorted.

    So what is the CCJ for? Would it be an ignored parking charge by any chance?

      If he wants to apply to pay a forthwith order by installment then he wants form N245 - he'll also want form EX160 for fee remission ( else it costs £50 application fee )

        Thank you that really helps, I don't think he received anything but he's not good with dealing with things plus his meds make him forgetful so to be honest it's 50/50.

        No it's not for parking charges, we don't have a car.

          It's quite a low amount to have a judgment on if not parking- do you know what the CCJ is for / who the claimant was etc ?

          Are you particularly worried about your credit files etc? - as a judgment will show on your file and be on the register of judgments for 6 years if it isn't paid within 28 days from the judgment date.

          Acknowledge Claim - within 14 days from Service

          Defend Claim - within 28 days from Service (IF you acknowledged in time)

          If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
