I am requesting to complete my defence for a County Court Claim I received on 03/10/24 regarding a Parking Charge from claimant National Parking Management Ltd. I was told that I until the 5th of November to submit this defence. I have left it a bit late, but I was dealing with some difficult personal circumstances.
Particulars of Claim:
The driver of the vehicle registration xxxxx (the 'Vehicle') parked in breach of the terms of parking stipulated on the signage (the 'Contract') at Market Street, on 22/12/2023 thus incurring the parking charge (the 'PCN').
The PCN was not paid within 28 days of issue. The Claimant claims the unpaid PCN from the Defendant as the driver/keeper of the Vehicle.
Despite demands being made, the Defandant has failed to settle their outstanding liability. The Claimant claims £100 for the PCN, £70 contractual costs pursuant to the Contract and PCN terms and conditions, together with statutory interest of £7.83 pursuant to s69 of the County Courts Act 1984 at 8.00% per annum, continuing at £0.04 per day.
I am the registered keeper of the vehicle, on the day in question, I was not the driver. I received a PCN dated 7/02/24 for a contravention on 22/12/23 for the amount of £100. I duly paid £60 (discounted, I have the receipt) for the first PCN received for this contravention on 17/01/24.
However, a few days later, I received another PCN for the same contravention. I viewed the images on the Claimant’s websites; both PCNs had the same images , even down to a man crossing the street, but had different dates.
I emailed the Claimant to seek clarification for the two PCNs, but they did not respond other than sending numerous debt collection letters.
