Please advise how to formulate reasons for lateness to appeal to the Upper Tribunal after First Tier decision was declined a few years ago. The First Tier hearing was decided using paperwork only, both parties did not attend in person.
There are compelling reasons and evidence for lateness to file, unsure how to list, what the length of the document should be, and general guidance as to the best format, information that should be added e.g. should a timeline of events be produced for clarity?
After a Mandatory Reconsideration Notice refusal to award PIP by DWP in August 2024, an appeal to Tribunal was filed. This was followed by an offer by DWP to award the benefit. They then oddly included the previous decision from 2021 which refused awarding the benefit, within the current appeal bundle.
The previous medical history confirmed issues, yet were disregarded by the First Tier Tribunal. The same information and additional evidence of more conditions now diagnosed were included this time. Clearly the DWP accepted a benefit award should be made as it is a genuine case, so the First Tier Tribunal decision of 2021 is totally unjust in view of the current circumstances.
HMCTS have advised to post a letter or email reasons for lateness.
