  • Trial Bundle Question

    Hello
    I have prepared my bundle for small claims, I am the claimant.
    do I just email the defendant the index to agree or the whole bundle in the first instance, I realise I email them the complete bundle, including theirs in the time scale directed by the court
    Also if I manage to email mine and defanants bundle to the court do i still drop in a hard copy for the hearing 3 days before the date.

    Your starting point is what the court has directed the parties to do. The standard directions in cases allocated to the Small Claims Track are that each party should provide a set of documents for the court.

    Remember to pay the hearing fee.

      Did the court order state you should produce a trial bundle?
      Court bundles are omitted under CPR 27 on the small claims track
      If the court requires a trial bundle it is normal for the legal representative to prepare it, or the claimant when both parties do not have legal representation, based on an agreed index

        No no no.

        You send your bundle by email to court and defendant

        you don't do any agreeing or hard copies.

          Please read
          CPR 39.5 (1) (a) and (b) regarding trial bundles and (2) claimant files the trial bundle

          Practice Direction 32 Evidence and in particular 27.1 to 27.15 Agreed Bundles for Hearing

          When you have read all that you will realise why trial bundles are omitted on the small claims track under 27.2 (1)(h)
