I wanted some advice on the next course of action for my court case.
My defence was struck out by the judge as the dispute in question with the claimant involves the wrong defendant name.
The judge quoted CPR 3.4.2 a) and b)
The claim was brought against me but the company name is wrong (call it A) and the judge gave the reasons for striking out the defence as the correct name of my company (call it B) is not the one with whom the agreement with the claimant is. Thus, the claimant has won by default.
Regarding enforcement, what do I do when the enforcement officers come around and company A does not exist?
Why has the judge not dismissed the claim on the grounds the legal names are incorrect?
