Hi, I'm a claimant in a case - I have sent the appropriate Claim form - N180 to Court and Defendant, have not yet been asked to provide the evidence listed on my initial Claim details yet have received a 'General Form of Judgement or Order' stating the claim is dismissed for the reasons :
a) It is a principle of English Law that any costs incurred by a party which would be recoverable as pre-action costs if a claim form is issued are not recoverable if, as in this case, that party decides not to issue a claim form.
What does this mean?
I have not recieved the N180 from the Defendant
Should I complete a N244 notice? Will I have to pay any more for this as I have already paid the court costs of over £400 and yet it has never gone to court!
I have rung the court to ask this but they did not know the answer!
