    Hi All,

    I'm submitting a claims to small claims for just under 5k against a major energy supplier. The claim in itself is very simple and there is no actual contract from the supplier for the work. Even if there was a contract, I'm sure it would never have allowed them to totally remove the water supply to a shower used by a disabled person.

    Anyway, I can submit the claim easily just on the bare facts of the case. However, a huge bulk of the paperwork is my frantic efforts over more and than a year to get them to finish the work. This is such an extensive amount of work its hindering my ability to submit the claim.

    With this in mind, would it be possible to submit the key evidence and then add the efforts to resolve as one appendix? I'm not sure anyone could dispute that I tried everything possible to resolve this situation, so this aspect will likely not even be in dispute.

    Any feedback would be so helpful

    First of all, if you are claiming there is no contract between you and the energy supplier, what legal basis are you seeking to bring a claim?

    Second, to start a claim you should not be submitting any information or evidence in your particulars of claim, that comes much further down the line in your witness statement.

    You should only rely on evidence that is really necessary to support your case so I would suggest you have a think about whether it is absolutely necessary for you to compile every single document or correspondence with the energy supplier when you could instead say that various correspondence back and forth occurred between two time periods. You can then simply refer to any specific document that you want to use to support the claim.

      Thank you, that all makes sense. On the contract issue, my claim would be that, I had a working shower before they came, and when they left I didn't. But also, an engineer attended when I first raised the complaint, and he agreed they should have reconnected a water supply to the shower. And this agreement was recorded.

        Send the energy supplier a Subject Access Request, they have 30 days to provide all the data on the account, make sure you get Proof of Postage. That will help with the communications you've had with the energy company.
