    Hi hoping someone can help?
    many years ago I took out a payday loan with the money shop and subsequently fell behind on the payments. I had a CCJ issued against me in January 2018- I did try to fight it but lost .
    Then I submitted a complaint about unfair lending but the money shop had already gone into administration by that time so I missed the boat.
    I have been making regular payments to BW Legal each month and the debt now stands at £199
    The CCJ was removed from my credit file this January and I have now moved abroad. So I have cancelled alot of direct debits including that one as I assumed it would just be written off. However have had this email come through

    We are sorry to see that your scheduled instalment payment has been missed which has resulted in your account falling into arrears of £35.00.
    Don’t worry, we understand this could have just been an oversight; if you are able to pay the arrears amount, plus any further instalment payments that fall due by 19 February 2024, this would then bring your current arrangement back up to date.

    Unfortunately, we do now need to make you aware that if we do not hear from you, or receive payment of the arrears by 19 February 2024, then your current agreed repayment plan will fail and we will continue to contact you about repayment of the current balance of £199.74. If the repayment plan fails and your case returns to our collection process, this will result in our client considering taking steps to enforce the County Court Judgment by way of a Warrant of Control via the County Court. If a Warrant of Control is issued then a County Court Bailiff will be instructed and they will contact you, which may include a visit to your current address.

    Any advice on how to respond? Can a warrant of control be issued now the CCJ is statute barred? And can a new CCJ be issued? Am I still obliged to pay after all this time? I would still like to have a good credit score incase I ever move back to the UK

    CCJ's do not become statute barred. With permission of the court, a CCJ over 6 years old can be enforced. Given that you have recently stopped your payments, such permission could well be granted.

    But do you have anything in the UK against which enforcement action can be taken?

      I do still have a bank account with some back up funds in incase I need to go home for any reason, thanks so much for getting back to me I will reset up the payment and take the hit I suppose it's just frustrating as I have been paying it for such a long time I had hoped it would of been settled by now I didn't even borrow that much but because I lost at court proceedings I had a hefty bill.
