  • Garage Repair Lodged At Small Claims

    Hi All,

    My car went for a repair (new clutch) and it started to fail straightaway. There has been many communication, most of them poor, with the garage. And although the garage is saying they will repair the car, I do not trust them. This is mainly due to me taking the car back for inspection, he then informed me it needed a new clutch, he then changed his mind and allowed me to leave with a clutch he knew was faulty. He has also been rude, ignored many emails etc. What would be the bar for when it becomes untenable to trust a garage with your car. I know this is subjective, but what might be useful case law? Or a rough guide? Thanks for reading

    Did the garage invoice you for a new clutch when you originally left your car to be repaired? How much was the bill?

      I am not sure that you are asking the right question. What is your claim against the garage - grounds of claim and amount claimed?

        Thanks for the replies. Sorry I'm late getting back to you, been side-tracked. I don't have an invoice but the amount was £500 (paid by card) and the claims is for a refund. Or they could arrange for another garage to do the repair. They are offering a remedy of changing the clutch, but I just don't trust them with my car.

          Am I understanding this right?
          You had a replacement clutch fitted by a garage, paid £500 by credit card, didn't receive or ask for an invoice and the fault with the clutch has reappeared shortly after picking up the car.
          The garage has offered to replace the faulty clutch again but you don't trust them and you have started a court claim to recover £500
          Your claim will be weak without the invoice stating the work the garage carried out
          Depending on where you live, court claims can take 9-15 months
