I am really upset as I had mediation last week and the mediator wasn't impartial.
Prior to the appointment I got an email saying about the general rules and what to expect but I don't feel those expectations were met.
The mediator called me half an hour late to tell me they were going to talk to the claimant to find out what has happened. When he called back he said "This is about an overpayment so how are you going to pay it back?"
I explained that there was more to it than that and he wasn't interested. The email said to have my defense handy as I would need to provide the mediator with some points from it but when I tried he told me he wasn't a judge but then made a judgmental comment of "Well it is public money"
He wasn't interested in anything I had to say I feel he sided with the claimant. He told me the claimant wants all the money paid back in 12 months, that's £800 per month I don't have it and no conversation was held around my income.
The mediation email said you can offer money work or goods. I offered the possibility of work from home which was refused by the claimant. The claimant entered into mediation with no intention of negotiating anything and the mediator agreed with this yet spoke to me like I was the problem.
I am so sad and disappointed. Is this common practice?
