Hi,
would anyone please know the costs of applying for a court order to access property and how long does it take? I have inherited a house from our parents and my sister and myself are now co-owners at 50% each of this property and she refuses me entry, it is a three bedroom house where she lives alone, no children, no family, no husband.
The second question is I told my sister if she wants to buy my 50% share of this property off of the inheritance assets she's free to do so at current market value, she offers £ 30,000 less than current market value to which I don't agree, I also told her if she doesn't have the money to buy she can sort something out like a mortgage etc. or we sell the property, now she cut all communication and stalled the inheritance process with her own solicitor who refuses to answer any of my questions over some bogus excuses they have to check documentation regarding the administration of our mother's estate, given this scenario what would you think would happen in court if I apply to force the sale of the property under section 14 of TOLATA since I am giving full options to my sister to either buy or sell the property?
Would anyone know how much it costs to apply to force a sale of property, someone told me the actual application is £ 350? I understand my solicitor should write to my sister's solicitor before to know what they are doing and if they continue to refuse etc then I apply to force the sale of the property.
Thanks.
