    Can anyone who has made a complaint to their solicitor or the law society, cast some light on the following isuues please:

    I complained to my solicitor with regards to his handling of my case. He ignored this, hence I I then took the matter up with the Law Society N.I.

    1/ He stated he had started legal proceedings against me when the Law Society contacted him regarding the complaint. No proceedings were ever issued.

    2/ He has failed to follow my instructions ie: he must have my medical evidence amended of all factual inaccuracies before they're disclosed as evidence. He has not contact the consultants to amend said reports. This has been the case now for 1 1/2 years. The consultants are happy to do so. But unfortunately they have not been contacted by him.

    3/ He did not reply to a SAR for info on how the case was to be funded also for details on how the case was to progress ( details of the barristers advice ) plus details of when & how he tried to contact the consultants to amend the reports.

    3/ When I tried to move the case to another solicitor, he told them, the insurance company the claim is against have instructed DWF to defend the case & it will be struck off shortly,
    I later contacted the insurance company myself to question this. They replied stating, this was not the case & they were simply waiting for the solicitor to disclose my medical reports.

    4/ At the start of the case he stated, I would not have to pay for medical reports & writs etc: once he started working on the case, I was told I would have to fund the case. No client care letter was issued.

    5/ Delay ( he has not followed my instruction. Therefore he is obviously delaying my case.

    6/ Continual threats he would sue me for all costs if I did not allow him to use the incorrect reports as they stand.


    When I received the reply from the LS, i was shocked at their response.

    The only charge against him was made in relation to the CC Letter.

    They claim he was acting under my instructions by not disclosing the reports ( no reference made to my instructions to amend the reports before disclosure ) !

    The SAR request could not be answered as he has a lien on my file. ! (LS regulations state, a SAR overrides a lien on clients files) Plus I was not looking for my file, only info which I'm entitled to by law.

    The lie he started legal proceedings overlooked.

    The lie DWF were dealing with my case & it will be struck off shortly, also overlooked.

Acknowledge Claim - within 14 days from Service

Defend Claim - within 28 days from Service (IF you acknowledged in time)

If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
