  • Case law for incorrect use of WP documents

    I am looking urgently for some case law that deals with WP documents being included in hearings
    ive found Jones & Anor v Lydon & Ors [2021] EWHC
    2322 (Ch) (23 August 2021
    anyone know of any others?

      Unilever v Proctor & Gamble 2000 (para. 23 of the decision) is generally the leading authority for exceptions to the WP rule. It has been added to a couple of times since then to include: interpretation of a settlement agreement, to be used as evidence in relation to terms under a settlement agreement and without notice applications.

      There's loads of case law on without prejudice rule but difficult to understand what cases are relevant without giving more context from your side.

        Its to do with a case involving a claim under the sales of goods act whereby emails etc done under WP have been included in witness statements by the claimaint
