    Good morning I’m wondering if someone can help me with a little advice.

    I have a ccj against me, to an individual, not a company bank etc.
    in June 2021 I applied to change the payments which the court agreed with. In January 2022 Nightfox asked for it to be redetermined.

    We had a phone hearing, the judge agreed I could pay £30 per month. I haven’t missed a single payment. It’s been made on time and even £35 most months.

    Around a month ago I received an email asking me to send proof of payment or it will be sent to high court. I told them they could find payments in there bank but sent screen shots anyway.

    A few weeks later a man named Brian replied. Saying he couldn’t find the payment for March and could I send it over. Previous to this interaction Nightfox have been very rude to me, they are aware I don’t want contact from them, again I told him to trace it on his bank as I’ve not missed a payment.

    Yesterday I eventually managed to log back into my bank where payments had come from in March and I sent a screenshot. His reply was it’s now with the high court, you have your attitude to thank and I quote “enjoy reruns of Jeremy Kyle” he also proceeded to attach screen shots of another ccj I’ve had over the years not with them.

    I have asked for ab amount left owing. The original debt was £1144 for the ccj. I have paid £650 of this so far. However there was meant to be a follow up hearing in June and it didn’t go ahead. The judge in this hearing asked them to provide proof for excessive fees over over £600 they wanted to add on. They didn’t update their phone number so this never went ahead.

    I am concerned that when they’ve sent it to the high court they’ve added these fees on, despite the fact I’ve never received a visit from them.

    I have been in tears because I’ve made sure I’ve stuck to every payment.

    I want to put in an n244 with all my proof of payments missed etc. but as they said they sent it to high court can I send this to the county court for the ccj or do I need to wait till I hear from the high court.


    I’d like to add I am a single mother of 2 children one who is under one and I am feeling very anxious about this.
