  • Error in Trial Bundle Small Claims Track

    I am taking my landlord to court who has decided to appoint solictors in their defence. Although not required on the direction, the solictor proposed a trial bundle of all the documents, which seemed sensible. I agreed the index but now having received the document it does not include the original evidence submitted by myself which I will rely on. I am looking for some guidance as to whether i) I can still rely on the evidence on the day ii) should send the court the missing documents an highligh the ommission iii) ask teh other side to redo the bundle. Graeful for any opinions

    When agreeing the trial bundle, did the index list include your evidence bundle, if so it could be a genuine error, just ask the solicitor for it to be added, if not do you have a paper trail ?

      Thanks for the reply. As a novice it was my error in assuming that the evidence supplied previously would automatically go in. The issue is that they we are a week away from trial so its my error just finding the besyt way to resolve it. thanks

        If it is in the small claims track you should follow the court's directions and submit your own set of documents with your statement.

        Ask the solicitor to add the documents you require. If they will not do that, prepare your own additional bundle and send that to the other party's solicitors and the court.
