  • Ordered Bailiff by mistake

    I recently got a Judgment Order on someone who owed me money, they where given 14 days to pay. They paid the money owed into my old bank account and was unaware of this. After the 14 days had passed I got Bailiff as I belived the money had not been paid.

    My question is whos fault is this mine or should they have let me know they paid me in my old account? Any thing I can do about the bailiff costs?

        If you notified the debtor of where the payment should be sent and the debtor failed to pay into that account then I would think it is the debtor's fault for not complying and I would be asking for the costs of the bailiff.

        If you didn't nominate the account then I guess you were too hasty in instructing a bailiff and you ought to have asked whether payment has been made first otherwise you intend to enforce the judgment.
