    Hi, my sister is currentlhy pursuing a claim for medical negligence which has left her significantly impaired, Running concurrently was a claim for Personal Independance Payment, which was initially refused. This decision has been overturned on appeal and she has been awarded the benefit. Can anyone advise me what the legal position is in terms of a duty to disclose to her solicitor? She was asked the question at an earlier stage if she was in receipt of any benefits and answered No which was the case at the time of asking. Now it has been awarded does she have to disclose?

    If a claimant is in receipt of a social security benefit for the same injury it might affect the compensation.
    The compensator may have to repay the DWP
    So now is the time to disclose to her solicitor

      If you do not need to, then disclosing will make no difference
      If you do (and you do) then you do.
