    hi,

    Hoping for some help with anyone who has previously been in this situation...

    - Creditor applied for a summary judgment over a debt of £1800
    - Judge agreed to adjourn hearing as documents hadn't been received by claimant
    - if after receiving the docs (still waiting for new hearing date) which will be at least 8 weeks + away, the claimant doesn't feel they have much prospect of winning the case, how would it be viewied if
    the claimant paid debt in full?
    - would the claimant be able to continue with the new hearing and try to claim costs? how would the court view this?

    any input would be great! thank you.

    I am confused. Some clarity will help.

    Are you the Claimant? What is your claim? Is the creditor the defendant, and applying for summary judgment dismissing your claim and/or on a counterclaim?

      Sorry, I’m the defendant, the hearing for summary judgement has been rescheduled as I wasn’t in receipt of any documentation from the claimant.
