    procedure for debt collection

    I have started to receive letters and calls from debt collection companies saying I ow money to some Utilities such as water and electricity. am I right in thinking in all cases there will be a defense form sent to me offering me a chance to file a defense before CCJ is taken ?

    or is there anyway without me given any chance CCJ could be taken against me?

    Yes. If you are sent a County Court Claim Form you will have the right to respond and contest the claim.

      It might be an idea to send a SAR now, so you have all the information if you have to defend a claim.

        Acknowledge Claim - within 14 days from Service

        Defend Claim - within 28 days from Service (IF you acknowledged in time)

        If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
