  • Care Home Fees Dispute

    I am in dispute with a care home that my mother was in before she died from Covid. Solicitors for the home are claiming three months unpaid fees before the council took over funding. I admit this was my fault due to addiction problems and mismanagement of
    my mother’s funds. I had mental health issues at the time and was not fully in control of my actions. They are now pursuing me for payment even though there are no funds in my mother’s estate. My mother’s care at the home was inadequate and they were negligent in her death from Covid. I do not know where I stand legally. The solicitors are willing to accept a payment proposal but otherwise seem to determined to take me to court over this. Any advice gratefully received.

    Had you agreed that you would pay the fees?

      If any of your mothers assets past to you, or anyone else, then the fees are payable. If you do not arrange payment then costs may be added to the account, so do try and deal with this as soon as you can.

      If your mother had absolutely no assets whatsoever, no investments or cash, then you can plead that there was no money unless you agreed to pay the fees prior to her death, in which case you need to pay.
