  • Parking eye small claims court false claim

    Parking eye gave me a PCN for staying in a car park they supervise. dec 2020.
    The issues with this were disputed as it was being serviced by Halfords and under their care for the duration. and Halfords confirm no PCN should have been issued.
    After opening a dispute with parking eye they refused my claim and issued a CCJ notice. after several months of defense and negotiation over 2021 they issued an offer to pay half, which I refused as I had done nothing wrong.
    They then informed the court (beginning of 2022) I had paid the fee and closed the case. Though they issued no notice of acceptance and refuse to give an invoice other than an invoice number. they refuse to discuss this and respond with they consider the matter closed.

    This feels very much like ParkingEye has used the court as a bullying tactic to try and gain money from me,
    what can I do?

    What is a CCJ Notice?

    Were you taken to court, and if so did you not contest the case?

      I had CCJ notice and filed a defense. The status was awaiting a court date to proceed. There was a period of document exchange and negotiation where they tried to get me to admit fault.
      Before a court date was set they told the court I had paid the fee. ( I had not) and only found out of this by the online case tracker. moneyclaim.gov.uk. My understanding is they needed to inform me of this and file a different notice canceling the CCJ. What they have actually done is misinformed the court and made me look guilty.

        I think this CCJ Notice may have been a Claim Form.

          I've had letters from the County Court and been given a case number by the court. I was waiting for the court date. (Delayed due to lockdown.)
