    Hi everyone.

    Got a car end of 2016 from moneybarn on a 5 year HP conditional deal. Everything was going fine until lockdown 1 when lost job and payments stopped. They eventually took me to court (CCJ) I offered £100 per week payment as I was back in employment. I contacted them in November to inform I was seriously ill and wasn’t working and on universal credit so would either have to pay a smaller payment or none at all. They declined and said I had to pay the agreed court amount. Over the next few months I was able to make payments here and there but nothing weekly as per the agreement.


    They have just sent an email out and letter to say the court order has failed and I have 14 days to make full payment of the outstanding balance. I explained my health circumstances again and offered again if there could be any chance they would accept a lower affordable amount until I have recovered and working again. Again they have rejected this. They want me to reply offering to voluntarily surrender the vehicle or pay within the 14 days in full. Failing this they will arrange a collection agency which will incur more charges.

    My question, is this legal for them to do this? Am I able to go back to the court and file an amendment to the original court arrangement even though moneybarn rejecting?

    Any advice is really appreciated. I am based in Scotland if this helps in regards to the laws.

Acknowledge Claim - within 14 days from Service

Defend Claim - within 28 days from Service (IF you acknowledged in time)

If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
