    So rang the courts note on system, then emailed them.
    Just received this from the mediation team it’s a reply to the email I sent them on the 18th May worded exactly as I have received!

    Dear Sirs,

    The Mediation Tam does not receive any documentation , please contact the court if you require any copy documents that have been filed.

    The email I sent them informs them I have not received the documents from the claimant I told them on the phone I have not received the documents from the claimant. I know they don’t receive documents I never asked for any from them I simply told them why I’m unable to mediate and to therefore cancel the appointment.

    Atm this is just ridiculous

      and they have now actioned by passing case back to court office - no mediation was possible just await courts next move move on now.

        Thanks Mike, I just hope they have as that email makes no sense and confirms nothing.
        I have done all I can though so yeah definitely moving on.

          The email mediation has sent you doesn't reflect the email you sent them.
          The person has misunderstood the information you have tried to convey.
          You think one thing, the Court thinks something else and mediation is thinking something else.

          You need to do the following:

          Give the Court a call, explain that you still haven't had the requested documentation from the claimant so mediation has been cancelled. Send the Court the same information via email. You really need to take charge of this.

            Thankyou and Sorry just saw this, yes I did ring the court straight away and also
            explained that I did not have the requested documentation so that mediation was cancelled. I also explained the full situation emails, phone calls etc with the mediation team and then emailed the courts the same information.

            The gentleman on the mediation phone call quite clearly told me the appointment was cancelled on Monday and he would be updating the courts. So I have absolutely no idea why I then received a reply to the previous email when I was informed it wouldn’t be actioned anyway as it was that phone call information only.

            I will ring the courts again on Monday morning, if mediation are still confused and ring on Monday for the appointment I will inform them again that I do have the requested documents from the claimant and that I assume would then cease the call anyway.

              Update I have rang the mediation team again this morning and yes appointment today is definitely cancelled and was cancelled when I rang them on the 1st June.
              It was also the 1st of June when I rang the courts myself to update and also followed that up in an email.
              So let’s see what happens next, I’m just hoping for some change I guess and not another pile of junk from Lowells/Overdales.

              Going forward can this process be repeated if need be? Or is it a case of if mediation is cancelled once that’s it?

                    look around site under lowells and a pattern comes up that they tend to push last minute then if ducks are not in a row = discontinue not always though every case can be different.

                      Thanks, yeah I have read so much but I think sometimes the mountain of information available on other cases makes you overthink your own personal situation at times especially when I’m comparing the journey(nightmare journey at that).

                        Just to update today I received a notice of transfer of proceedings confirming the mediation has referred the case to a hearing centre (my local court).
                        I am to await the judges directions.
                        I’m assuming this is all standard practice?

                            Another update received another notice of transfer of proceedings yesterday to another court(also local).
                            On receipt the file will be referred to a procedural judge who will allocate the claim to track and give management directions. Details of the judges decision will be sent to me in a notice of allocation.

                              'Details of the judges decision will be sent to me in a notice of allocation', you mean 'Judge's instructions' to both parties.
