  • Defending a Claim, Help

    Good Morning,

    My DQ was sent back via email to the court (as per advice from the court on the phone) and I have an email receipt to say it was received before 4pm on the day it was due. The advisor assured me this would mean it would be recorded as being received on that date - as long as it was sent before 4pm - I think I sent it at about 10am on 29/12/21.

    However, on MCOL, it shows that it was filed on 13/01/22 and now it is showing as a general sanctions order being made.

    Would it show on my log if it was the claimant who was receiving the sanction?

    I received a copy of their DQ earlier this week, and wondered if they had sent it late as would assume they would have been given similar / the same dates as me? But I have no idea.

    If the sanction is for me - what will it be for? Can I challenge it? What does it mean?

    Sorry for so many questions, this is the first time I have had to deal with something like this and I'm finding it quite overwhelming.

    If you emailed your DQ on the 29/12/21, then that is when you filed it. It might take time for it to be entered onto the court system. What I would do is phone and email the court and seek clarification, from what you have said you are 'bang on' regards your time lines. It is better to get the your time line corrected now.

      I gave the court a call; they said it shows their end I have filed on time and have nothing to worry about. They are still waiting on the DQ from the claimant and as such have issued the sanction to them. I am guessing they have filed it late and the court has a back log as we received a copy of theirs this week.

        Defend Claim - within 28 days from Service (IF you acknowledged in time)
