    Hello,

    So i'm after a little clarification on my position.

    We bought a car through Arnold Clarke years ago, finance was provided by Marsh Finance.

    We scrapped the card after paying off 95% of everything that was owed. They didn't contact us for months possibly over a year, then in 08/2016 obtained a ccj against us for the little bit of balance left and the maximum interest they could have added. Overall about £1500

    I had been paying this off and thought it was cleared haven't heard off them sine 2018, despite me chasing them for clarification 4 times to see if it had been settled. Nothing.

    Until today a letter for their litigation department asking for £500 balance or they will pursue other options.

    Do i have any standing as they have made no contact?

    I have emailed them asking for a list of all payments made and want to tally them up with my records.

    So looking for next steps really. thanks for reading.

    What have they sent you? Is it a Letter Before Action?

    Send / email them a SAR, to their Data Protection Team they have 30 days to provide you with all the data they have on your account.

    Then you can decide how to proceed, how did you seek clarification that the account had been settled (4 times)? Was it in writing?

      Thanks for your reply.

      Well they already have the ccj so i'm not sure what more action they can take.

      I will email send them a SAR today.

      To seek clarification I emailed them 4 time (had read and delivery receipts) but no reply.

        Write a Letter of Complaint, mark it as such, Explain what's happened, that you sought 4 times clarification that all payments to the account had been made. That they didn't respond. Explain what you want them to do, write off the amount, remove the CCJ. Send them the 4 emails with delivery receipts. Tell them if they can't do that, then you want them to provide you with a final response / deadlock letter, so that you can lodge a complaint with the Financial Services ombudsman.
