  • Particulars of claim help - what do i include?

    Hello and thanks for reading.

    Background
    So we had our garden landscaped in March and we are starting a claim via the MCOL and asking for our money back - £3,880.
    The finish is awful and we have sent detailed letters and info with pics previously to him but had no reply. So our only option now is the small claims court.
    The paving has been laid terribly (posted pics on facebook and had comments such as it was the worst they had ever seen) and it actually breaches building regulations. It should be 150mm below the damp proof course. The paving laid is only around 70-80mm below the DPC. We have been informed this will cause damp within the property.
    The finish is not what we asked for and in particular around 2 grids which is actually dangerous. He did offer to rectify ('bodge') these but we want the whole thing re-doing and have lost all confidence in him as a tradesperson (stated this in a letter to him).
    We have told him he has breached the consumer rights act 2015 previously too.

    Help!
    I just wanted some advice regarding what to include in my 'Particulars of claim' Can anyone help with wording to include. Do i just list what we paid and what he has breached?
    I am devastated with what has happened (the money used was from my mum who passed away last year) so this means so much to me to get it back and my garden put right! I also do not want this to happen to anyone else!

    Have you sent him a letter before action, because that's the starting point before starting legal proceedings.

      We have sent 3 letters to him, he has not replied to any of them. He is not a member of an ADR scheme so the next step is the small claims court
