  • Set aside a CJJ **HELP**

    Hi,
    I am applying to set aside a CCJ that was given to me in my absence and without my knowledge. I didn't receive any court papers or such like, the first I knew about it was a Notice of Enforcement letter through the post.
    I'm aware of the person/situation surrounding the order though, it relates to an old business colleague of mine. Long story short, he says i owe him a sum of money, which i absolutely do not!
    I am trying to write to Witness statement and draft order, draft defence but i'm chasing my tail it feels like, i can't seem to work out exactly what i need to write.
    There's several different issues here

    1 - I didn't receive the the court documents so didn't have the chance to defend the claim.

    2 - I disagree with the claim completely as i don't owe this person any money full stop.

    3 - It's already at Baliff stage

    Please can someone explain to me the best approach to take here and even better point me in the direction of a thread where someone has had a similar experience?

      Acknowledge Claim - within 14 days from Service

      Defend Claim - within 28 days from Service (IF you acknowledged in time)

      If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
